July 2026
On 17 July 2026, the Criminal Court of Genoa, in the proceedings concerning the collapse of the Morandi Bridge, acquitted the client represented by the Firm of all charges. The client had served as Chief Executive Officer and General Manager of Autostrade from 1995 to 2000. The defence was led by Professor Luca Lupária Donati and Professor Mitja Gialuz. The proceedings, among the most significant and complex in recent Italian judicial history, lasted four years and involved 284 court hearings.

On 11 July 2026, the Italy Innocence Project team participated, at the invitation of Innocence Project Deutschland, in the international conference “When Should a Procedural Error Justify Reopening a Final Criminal Conviction?”, held at Humboldt University in Berlin. The conference brought together scholars, lawyers, and representatives of leading Innocence Projects from around the world to discuss the role of procedural errors in reopening final criminal convictions, comparing different national models of post-conviction review and the institutional mechanisms for correcting miscarriages of justice. Italy was represented by Martina Cagossi, co-founder and Program Manager of the Italy Innocence Project.

From 22 to 26 June 2026, the Italy Innocence Project team took part in the international conference organised by the Innocence Network near Helmond, in the Netherlands. The meeting brought together representatives of the leading Innocence Projects from every continent, providing an important opportunity for discussion on the most recent developments in the fight against wrongful convictions, on international cooperation, and on future initiatives of the innocence movement.

On 8 June 2026, Professor Lupária Donati took part in the conference “L’errore giudiziario. Il caso Beniamino Zuncheddu” organised by the Criminal Law Commission of the Rome Bar Association, in collaboration with AIGA Roma and Legance. The event, devoted to one of the most significant cases of judicial error in Italian history, provided an important opportunity for discussion on wrongful convictions, procedural safeguards, and the mechanisms for reviewing final judgments.

On 22 May, Professor Lupária Donati also took part in the fourth edition of the Printemps du droit, dedicated to the theme “Justice in the Era of Post-Truth. Between the Relative and the Universal”, held at the University of Tuscia in Viterbo, contributing to the discussion on the transformation of justice in the age of post-truth.

On 21 and 22 May, the international conference organised within the framework of the PhD programme in “Law and Business” of the Department of Legal and Economic Sciences of Sapienza University of Rome was held on the topic “The Reform of Legislative Decree No. 231/2001 in the International Dimension”. During the third session, devoted to practical, procedural and substantive criminal law issues, Professor Lupária Donati delivered a presentation on the procedural aspects of corporate criminal liability.

From 14 to 17 May, the seventh edition of the Festival della Giustizia Penale took place, a prominent event within the Italian legal landscape. Professor Lupária Donati serves as its Scientific Director, while Avv. Martina Cagossi is a member of the organising committee.

On 5 May, Professor Lupária Donati’s new book, co-authored with Giuseppe Gennari and Franco Tarone and entitled La scienza non giudica, was published. The work reflects on the relationship between science and criminal proceedings, focusing in particular on the role of scientific knowledge in the formation of judicial decisions.

Professor Luca Lupária Donati was invited to speak at the international event entitled “Interrogatorio y confesión. La experiencia italiana entre el caso de Amanda Knox y las nuevas amenazas tecnológicas”, organized by the Fundació de l’Il·lustre Col·legi d’Advocats de les Illes Balears (Palma de Mallorca). His presentation focused on interrogation and confession in light of the Italian experience and the new challenges posed by technological innovation.

The eighth edition of the “Codice sistematico di procedura penale”, edited by Professor Lupária together with Professors Belluta and Gialuz, has been released. The work is a key reference for scholars and practitioners.

Professor Lupária has published the essay “The Innocence Movement Revolution: History and New Frontiers”, included in the volume “Causes and Remedies for Wrongful Conviction: A Comparative Analysis” (Aranzadi, Madrid, 2026), focusing on recent developments in wrongful conviction review from a comparative perspective.
